  1. Seller has sold Buyer the above named pet quality pure-bred dog/bitch, hereafter referred to as the Mastiff, which is guaranteed to be healthy and free of debilitating diseases, for $___________ (______________________) and shipping expenses/transportation expenses if any. Shipping expenses to include the airfare, crate, veterinarians health certificate, and will not usually exceed $___________ (_______________________).

    The Seller will provide a five generation pedigreed on the Mastiff as an attached addendum to this contract labeled addendum #1.

  2. The Buyer agrees to keep the Mastiff confined from traffic with access to a fenced yard, properly sheltered, with adequate food and water, give love and attention, and provide regular veterinary care. The Buyer also agrees to never allow the Mastiff to ride loose in the open bed of a pick up, ranchero, jeep or similar vehicle unless the Mastiff is crated. The Buyer further agrees that this Mastiff will never, at any time, be trained as a guard/attack dog nor will the Mastiff be used as a fighting dog. The Buyer agrees to use a collar and leash when taking the Mastiff anywhere except Buyer's own property. Buyer also agrees to never using a choke or pinch collar except during training class or exercises. The Buyer also agrees to enroll the Mastiff in a sanctioned Dog Obedience Class, and, upon completion, send a copy of the Graduation Certificate, along with a copy of the canceled check or receipt, to Seller, who will refund the cost up to $25.00 of the Obedience Class. The Buyer agrees to register the Mastiff with the American Kennel Club (AKC) within sixty (60) days of receipt of the registration application (blue slip) or sooner if the blue slip expires before 60 days of receipt thereof. The Buyer also agrees to use the kennel name of Monarch in front of the registered name. IE: Monarch's Phydeaux. The Buyer agrees to send a copy of the registration certificate to the Seller within ten days of receipt from the AKC. The Buyer agrees to register the microchip number of the Mastiff with an appropriate recovery agency and to send a copy of the registry conformation to the Seller within ten days of receipt.

    The Buyer has five (5) working days from receipt of the Mastiff to have the Mastiff examined by a veterinarian. If a problem is detected by the veterinarian, the Buyer may return the Mastiff for a full refund of purchase price. The Buyer agrees to provide a signed statement from the examining veterinarian detailing the health problem. If the Buyer decides to keep the Mastiff, the Seller will not be responsible for any veterinary costs incurred. The Seller reserves the right to have the Mastiff examined by a veterinarian of the Seller's choice, at Seller's expense, for a second opinion of the condition. The AKC registration papers will be sent to the Buyer after the veterinary exam and acceptance of the Mastiff by the Buyer.

  3. The Buyer agrees to do preliminary OFA hip and elbow x-rays at the age of six (6) months and to send the x-rays to the Seller to be submitted with the rest of the litter. The Buyer also agrees to have the Mastiff x-rayed for hip and elbow configuration between the ages of twenty four (24) to twenty six (26) months and send said X-rays to the Orthopedic Foundation for Animals, Inc. (OFA) for permanent evaluation and registrations. The Buyer also agrees to send a copy of the OFA report and/or certificate to Seller within ten (10) days of receiving the OFA reports. If said x-rays are taken at 24 months and sent to the Seller to be submitted to the OFA along with the rest of the littermate's x-rays, the Seller will pay all OFA fees involved. The Buyer agrees to have the Mastiff's eyes examined by a veterinarian affiliated with the Canine Eye Registry Foundation (CERF) by the age of thirty (30) months and every year thereafter. If the Buyer sends the original of the exam sheet to the Seller within ten days of the exam the Seller will send the original exam sheet to the CERF for registration, and the Seller will pay the cost of registration.

  4. The Buyer agrees to have the Mastiff neutered/spayed by the age of twelve months. Under no circumstances is this Mastiff to be bred or used for breeding purposes. The AKC registration papers will be marked limited by the Seller. The American Kennel Club registration for this Mastiff is limited and states that no off-spring are registerable. Under no circumstances is the Mastiff to be bred to another Mastiff or any other kind of canine, domestic or wild. The Buyer agrees to send a copy of the veterinarians bill or statement providing proof of spaying/neutering within ten days of when the surgery was performed. The Seller reserves the right to retain the AKC papers until proof of spaying/neutering is received. Should the Buyer decide that they would like to show or breed the Mastiff at a later date, the Seller may, at Sellers discretion, allow the Buyer to sign a Show Contract, pay the difference between pet and show price, and pay for the cost of transferring the limited registration paper to a full registration. No transfers will be made until the Mastiff is evaluated by the Seller or Seller's agent as a show potential Mastiff, and the Mastiff has had at the least, the preliminary OFA hips and elbows done and are evaluated as good or excellent by the OFA. The CERF and thyroid exams must also be current and within passing limits. The Seller strongly encourages the Buyer to have the Mastiff OFA Heart and Patella certified at the age of one (1) year.

  5. The Buyer agrees to follow the feeding, rearing and vaccination guidelines provided by the Seller at the time of sale as attached addendum to this contract. The Mastiff is never to be fed a diet specifically for puppies, and the Buyer agrees to feed only a premium adult food as outlined in the feeding guideline addendum, labeled addendum #2. The Seller will provide a complete vaccination and deworming record and a vaccination schedule on a separate page, labeled addendum #3. Continued deworming to be determined by a veterinary fecal exam. The Buyer agrees to administer daily or monthly heartworm preventative starting no later than when the Mastiff is three months old and to be continued for the life of the Mastiff.

  6. The Mastiff is being sold as a pet and is guaranteed against any defects which would preclude the Mastiff from functioning as a family pet. The Mastiff is guaranteed against hip and elbow dysplasia until the age of thirty months and, for life, for genetic eye defects which would cause blindness. If the Mastiff is found to have an OFA hip rating of moderate or severe, OFA elbow rating of bilateral ununited anconeal process, or bilateral DJD grade III, or become blind due to a hereditary defect, at Sellers discretion, Seller will, upon return of the Mastiff either replace the Mastiff with another of greater value, or allow the Buyer to keep the Mastiff and purchase another pet quality Mastiff at a reduced price; or refund a percentage of the original purchase price. This guarantee is not valid if the Buyer violates any other section of this contract and does not do the testing as outlined in paragraph 3.

  7. Buyer hereby gives Seller or Seller's agent permission to enter Buyer's premises for purposes of visitation or inspection of the Mastiff's environment. If the Buyer is ever charged or convicted of animal abuse or cruelty by any state, local or federal agency, or the AKC; or has their AKC privileges revoked for violating the AKC rules and regulations, the Buyer forfeits all rights to Mastiff and will immediately remand custody of said Mastiff to the Seller. All AKC papers to accompany the Mastiff. Buyer will not receive any refund of monies paid to the Seller.

  8. If, for any reason, the Buyer can no longer keep the Mastiff, ownership will revert to the Seller, for no more than the price stated above, less any refunds. Return price is dependent upon the age and condition of the Mastiff, as determined by a competent veterinarian, and other reliable breeders, and being able to place the Mastiff in a new home within thirty (30) days of the Mastiff's return. After that time, a usual, daily kennel fee of $8.00 per day will be charged against the Mastiffs purchase price until it is placed or until the purchase price reaches zero. Seller may agree to have the Mastiff placed in a new home by the Buyer, with the new home previously approved by the Seller. Under no circumstances is this Mastiff to be transferred to another owner without written consent of Seller.

    The Buyer guarantees the Seller the first right of refusal. In the event that the Buyer can no longer keep the Mastiff, and the Seller is dead, incapacitated, or otherwise unavailable, the Buyer agrees to relinquish the Mastiff to an authorized agent of the Mastiff Club Of America, Rescue Division, for care and placement of the Mastiff into a new home.

  9. Since violations of this sales agreement may be detrimental to the reputation and value of the Seller's Mastiffs and kennel name, Buyer agrees that any such violation entitle Seller to payment, on demand, of an amount equal to five (5) times the above stated cash sales price and the Buyer will remand immediate return, at the Buyers expense, of the Mastiff to the Seller with no monies refunded to the Buyer. In the event that the Seller must contact an Attorney or other legal agency to enforce this contract, all expenses shall be paid by the Buyer, including Attorney's fees, court costs, and any other expenses involved in enforcement of this contract. This contract shall be deemed enforced if any suit is filed by Seller against the Buyer in Bexar County, Texas. If any provision of this contract is found to be unenforceable, then such provision shall be severed and the remaining provisions of the contract shall have full force and effect.

  10. No provision in this contract may be amended without the written approval of both the Seller and the Buyer.
